Re: Statement pursuant to art. 13 Legislative Decree 196/03 “Code regarding the protection of personal data”
Preamble
Following the regulation dictated by the Legislative Decree 196/03 “Code regarding the protection of personal data” (hereinafter referred to as the “Code”), Fratelli Martini Secondo Luigi S.p.A., as Data Controller, is required to provide some information regarding the use of your Company’s personal data.
Source of the personal data
The data in our possession, collected directly from the data subject, will be processed in compliance with current legislation, and with due confidentiality.
Purpose of the processing
The collection, or rather the processing of personal data has the sole purpose of properly fulfilling the requirements related to the performance of our company’s economic activity, and specifically to:
Processing methods
In relation to the purposes indicated, personal data is processed using manual, electronic and web tools with a logic closely correlated to the purposes themselves, and nonetheless in such a way as to guarantee the security and confidentiality of same data in compliance with the Code.
Nature of collection
The collection of some personal data is also compulsory for legal and fiscal requirements, and refusal to provide such data shall make it impossible to enter into relations with our company.
Communication and disclosure
The personal data and processing of the same shall be communicated to external companies and/or consultants for the performance of economic activities (commercial, management, collection of economic and financial information, management of information systems, insurance, banking and other mediation, factoring, shipment, sealing and sending correspondence, credit management and protection) or for legal requirements (Accounting and Tax Advisory firms, notaries, attorneys, Revenue Office). The data shall not be disclosed.
The following categories of subjects in charge of processing may become aware of your data : Administration; Foreign Trade; Italian Trade; Marketing & communication; Production Planning Office; Microbiology and Quality Control Laboratory; Safety/Quality/Compliance; Purchasing Office.
Data subjects’ rights
You may contact the Privacy Service at the Data Controller to verify your data and have them integrated, updated or corrected and/or to exercise the other rights pursuant to art. 7 of the Code (see attachment).You may also, at any time, object to the processing of your data for the purpose of sending promotional and advertising material.

Art. 7 legislative decree 196/03 (Rights to access personal data and other rights)
1.The data subject shall have the right to obtain confirmation as to whether or not personal data concerning him/her exist, regardless of their being already recorded, and their communication in intelligible form.
2. The data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purpose and methods of processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning the data controller, the data processor and the representative designated as per article 5, paragraph 2;
e) of the entities or categories of entity to which the personal data may be communicated and which may have access to the said data in their capacity as designated representative(s) in the territory of the State, as data processor(s) or as person(s) in charge of the processing
3. The data subject shall have the right to obtain:
a) updating or rectification or, where interested therein, integration of the data;
b) erasure, anonymisation or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purpose for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b), including their contents, have been made known to the entities to which the data have been communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared to the right to be protected
4.The data subject shall have the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising material or direct selling or else for market or commercial communication surveys.
